Welcome to Tokidoki Home (the "App"), operated by Jan Hamsch und Kai Hamsch GbR ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of the App and its services. By downloading, installing, or using Tokidoki Home, you agree to these Terms. If you do not agree, please refrain from using the App.

Tokidoki Home is a mobile application that enables users to create and manage a household. Friends and family members can join a household and work together on it. The App offers various subscription models: users can either subscribe to an individual subscription (monthly or yearly) for themselves or a household subscription (monthly or yearly) for their entire household.
By using Tokidoki Home, you confirm your acceptance of these Terms and our Privacy Policy. These Terms form a binding agreement between you and us.

You are responsible for keeping your account credentials secure and for all activities under your account.
Users can create and manage a household. The creator of the household is referred to as the household administrator and has extended administrative rights.
Friends and family members can join a household if they receive an invitation or know the join code. By joining, they gain access to the household's features according to the subscription level.
The household administrator can remove members from the household.
The household administrator is responsible for the activities of all household members and ensures that all members comply with these Terms.
Tokidoki Home offers two types of subscriptions:
The prices and features of the various subscription plans are displayed in the App and may change from time to time.
For a household subscription, the subscription is managed and paid for by the household administrator. All household members receive access to the features according to the subscription plan.
If a member leaves the household, they lose access to the household features but retain their individual account.
Payments are processed via the Apple App Store or Google Play Store platforms, depending on your device, and are subject to their terms and conditions.
Subscriptions auto-renew unless canceled at least 24 hours before the billing cycle ends.
Prices include applicable taxes (e.g., VAT).
Per German law, you may have a 14-day withdrawal right for initial subscriptions. For In-App Purchases, including subscriptions, the withdrawal right can be exercised through Apple's refund process at reportaproblem.apple.com or Google.
You can cancel your subscription at any time. The cancellation becomes effective at the end of the current billing cycle. You retain access to the features until the end of the already paid period.
For a household subscription, cancellation by the household administrator results in all household members losing access once the paid period expires.
No refunds are provided for unused subscription periods, except where required by law.
For In-App Purchases, please contact Apple through reportaproblem.apple.com or Google to request a refund within the applicable time frame.
We grant you a non-exclusive, non-transferable, revocable license to use Tokidoki Home for personal, non-commercial purposes, subject to these Terms.
You retain ownership of all content you create or upload in the App, but grant us a worldwide, royalty-free, non-exclusive license to use, store, and process it as needed to provide the App's services.
You must not upload illegal, infringing, or harmful content, including but not limited to nudity, violence, hate speech, or anything illegal under German law.
We may remove such content without notice.
You guarantee that the uploaded content does not violate third-party intellectual property rights and that you have the necessary rights to grant us the license as described above.
Tokidoki Home, including its code, design, and all features, is owned by Jan Hamsch und Kai Hamsch GbR or our licensors.
You may not reproduce, modify, or distribute the App without permission.

Tokidoki Home may rely on third-party services. We are not liable for their performance or outages.
Third-party terms and privacy policies apply to their use.
Your data is handled per our Privacy Policy, which complies with GDPR and other applicable laws.
For household subscriptions, household members may access certain shared data. The household administrator can manage data visibility settings.
We may update Tokidoki Home or these Terms at any time. Updates will be posted with a revised "Last Updated" date.
Continued use of the App after changes constitutes acceptance of the new Terms.
We may suspend or terminate your access for violating these Terms or at our discretion, with or without notice.
Upon termination, you lose access to all App features. For a household subscription, termination of a member by the administrator or by us may affect all members.
Tokidoki Home is provided "as is" without warranties, express or implied, including fitness for a particular purpose.
We do not guarantee the availability, accuracy, or reliability of the App or its features.
We are not liable for indirect, incidental, or consequential damages (e.g., data loss) to the fullest extent permitted by law.
Our liability is limited to amounts paid by you in the prior 12 months.
You agree to indemnify us against claims arising from your use of Tokidoki Home or violation of these Terms.
These Terms are governed by German law, excluding conflict of law rules.
Disputes shall be resolved in the courts of Freiburg, Germany, unless consumer protection laws dictate otherwise.
We are not liable for delays or failures due to events beyond our control (e.g., natural disasters, server outages).
If any provision of these Terms is invalid, the remaining provisions remain enforceable.
These Terms, along with the Privacy Policy, constitute the full agreement between you and us.
Our failure to enforce any right does not waive that right.
You may not assign these Terms without our consent. We may assign them freely.
